General Terms and Conditions (GTC) of Pension Haus Erholung

1. Conclusion of the contract

The accommodation contract is concluded as soon as the room or apartment has been ordered by the guest and confirmed by Pension Haus Erholung, or – in the case of short-notice bookings – made available. Both the order and the confirmation may be made in a legally binding manner by telephone or in writing by post, fax or email.

Conclusion of the accommodation contract obliges the contracting parties to perform the contract, regardless of the duration for which the contract has been concluded.

The guest acquires no entitlement to the provision of specific rooms or apartments. A binding commitment to specific rooms or apartments requires written confirmation from Pension Haus Erholung.

Should agreed premises not be available, Pension Haus Erholung is obliged to endeavour to provide equivalent alternative accommodation.

2. Arrival and departure

Rooms are available on the day of arrival from 2:00 p.m., apartments from 3:00 p.m. If you arrive later than 6:00 p.m., we ask that you let us know. On the day of departure, the room/apartment is available to you until 11:00 a.m.

3. Services and prices

The contractual services result from the details in the reservation confirmation. Information given by telephone, collateral agreements and other consents of any kind form part of the contract only if they have been confirmed in writing by Pension Haus Erholung.

All prices are quoted in euros, including VAT. Payment is possible in cash or by EC, VISA or Master card.

4. Withdrawal from the contract (cancellation) by the guest

Cancellation up to 14 days before the arrival date is possible free of charge. The decisive point in time for the withdrawal is the receipt of the notice of withdrawal by us. For cancellations made later, as well as for no-shows or curtailment of the stay, a cancellation fee of 80% of the price of the entire booking is charged.

Up until the start of the stay, you may be represented by a third party. We recommend taking out travel cancellation and curtailment insurance.

A special service for guests who have booked directly with us: should you need to cancel after the end of the free cancellation period, Pension Haus Erholung will endeavour to re-let the accommodation in order to reduce the cancellation costs. There is no legal entitlement to this service. Even where the accommodation is re-let, costs may arise due to additional cleaning or reduced rates.

Unfortunately, for administrative reasons, we cannot offer this service to guests who have booked via booking portals such as booking.com or check24.

5. Withdrawal from the contract by Pension Haus Erholung

Pension Haus Erholung reserves the right to withdraw from the contract if performance of the service has become impossible due to force majeure, without any claims for damages arising as a result.

6. Liability

The guest is liable to Pension Haus Erholung for any damage they culpably cause during the term of the contract. The guest is obliged to report such damage to the owner of Pension Haus Erholung during their stay.

If the guest is provided with the on-site parking spaces, no contract of safekeeping (bailment) comes into being. The guesthouse is under no duty of supervision. The guesthouse accepts no liability for any damage occurring to the vehicle.

Use of the on-site bike room is at the guest’s own risk. The guesthouse is under no duty of supervision. The guesthouse accepts no liability for damage or theft by third parties.

For fire-safety reasons, bicycle batteries may be charged only in the bike room. Owners are liable for any damage caused by their bicycle or bicycle battery.

7. Final provisions

In commercial dealings, the place of performance and the place of jurisdiction is Cochem. The law of the Federal Republic of Germany applies.

Should individual provisions of the contract or of these general terms and conditions be invalid, this shall not affect the validity of the remaining provisions. The corresponding provision of the BGB/HGB (German Civil Code / German Commercial Code) shall apply in place of the invalid provision.

Important notice regarding the right of withdrawal!

Please note that, under the statutory provisions (Section 312g(2) sentence 1 no. 9 BGB – German Civil Code), no right of withdrawal (i.e. no free right of cancellation) exists for accommodation contracts (contracts for accommodation with or without additional services), even where these have been concluded by means of distance selling (by telephone, online, by fax or by email); instead, the statutory rules of tenancy law (Section 537 BGB) apply.

Accordingly, after conclusion of the contract – unless a free right of cancellation has been expressly agreed – only the option of a chargeable withdrawal or cancellation exists, in accordance with the host’s terms and conditions (insofar as these have been validly agreed) or in accordance with the statutory provisions.
